AP 32: FISHING LICENSES: EXPIRATION.

UNDER EXISTING LAW, ANY PERSON OVER 16 YEARS OF AGE WHO TAKES A FISH, REPTILE, OR AMPHIBIAN FOR ANY PURPOSE OTHER THAN PROFIT IS REQUIRED TO FIRST OBTAIN A LICENSE FOR THAT PURPOSE FROM THE DEPARTMENT OF FISH AND GAME. UNDER EXISTING LAW, ONE TYPE OF LICENSE IS A SPORTFISHING LICENSE THAT IS ISSUED TO A RESIDENT 16 YEARS OF AGE OR OLDER, FOR THE PERIOD OF A CALENDAR YEAR, OR IF ISSUED AFTER THE BEGINNING OF THE YEAR, FOR THE REMAINDER THEREOF, UPON PAYMENT OF THE APPLICABLE FEE LICENSES INCLUDE REDUCED FEE LICENSES FOR ELIGIBLE DISABLED VETERANS AND PERSONS OVER 65 YEARS OF AGE.

THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD REQUIRE THAT A STATE FISHING LICENSE EXPIRE ONE YEAR FROM THE DATE OF ISSUANCE.

VOTE: MAJORITY.

AP 32: RELATING TO FISHING LICENSES

WHEREAS, A CALIFORNIA FISHING LICENSE EXPIRES ON DECEMBER 31 OF THE CALENDAR YEAR IN WHICH IT IS RENEWED; AND

WHEREAS, A CALIFORNIA MOTOR VEHICLE REGISTRATION EXPIRES ONE YEAR FROM THE DATE IT IS ISSUED; AND

WHEREAS, CALIFORNIANS WHO ARE ISSUED A FISHING LICENSE AFTER JANUARY 1 OF A CALENDAR YEAR DO NOT ENJOY A FULL YEAR OF USE; AND

WHEREAS, A PERSON WHO PAYS FOR A PRIVILEGE OR SERVICE SHOULD HAVE THE RIGHT TO ENJOY A FULL YEAR OF USE OF THAT PRIVILEGE OR SERVICE; AND

WHEREAS, MANY ELDERLY CALIFORNIANS FISH AND, SINCE THEY ARE ON FIXED INCOMES, ARE LESS LIKELY TO PURCHASE A FISHING LICENSE BECAUSE IT IS NOT VALID FOR A FULL YEAR; AND

WHEREAS, FAILURE TO PROVIDE A FULL YEAR OF USE FOR A FISHING LICENSE LIKELY LEADS TO CALIFORNIA LOSING REVENUE DUE TO VIOLATIONS OF FISHING LICENSE PURCHASE LAWS; AND

WHEREAS, ARKANSAS, FLORIDA, GEORGIA, HAWAII, MISSISSIPPI, TENNESSEE, TEXAS, AND VIRGINIA ISSUE FISHING LICENSES VALID FOR A FULL YEAR OF USE FROM THE DATE OF PURCHASE; AND

WHEREAS, CALIFORNIANS DESERVE A FULL YEAR OF USE OF FISHING LICENSES; NOW, THEREFORE, BE IT

RESOLVED, BY THE SENIOR ASSEMBLY AND THE SENIOR SENATE, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2012 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT A STATE FISHING LICENSE EXPIRE ONE YEAR FROM THE DATE OF ISSUANCE; AND BE IT FURTHER

RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER

RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE SPEAKER OF THE ASSEMBLY, THE PRESIDENT PRO TEMPORE OF THE SENATE, AND THE GOVERNOR OF THE STATE OF CALIFORNIA.
