AFP 3: SEX DISCRIMINATION IN FEDERALLY FUNDED PROGRAMS AND ACTIVITIES.
UNDER EXISTING FEDERAL LAW, DISCRIMINATION ON THE BASIS OF RACE, COLOR, OR NATIONAL ORIGIN IS PROHIBITED IN ANY PROGRAM OR ACTIVITY RECEIVING FEDERAL FINANCIAL ASSISTANCE.
THIS MEASURE WOULD MEMORIALIZE THE CONGRESS AND THE PRESIDENT TO ENACT LEGISLATION THAT WOULD ALSO BAN DISCRIMINATION ON THE BASIS OF SEX IN ANY PROGRAM OR ACTIVITY RECEIVING FEDERAL FINANCIAL ASSISTANCE.

WHEREAS, TITLE VI OF THE FEDERAL CIVIL RIGHTS ACT OF 1964 (42 U.S.C. SEC. 1981 ET SEQ.) BANS DISCRIMINATION IN ANY PROGRAM OR ACTIVITY RECEIVING FEDERAL FINANCIAL ASSISTANCE ON THE BASIS OF RACE, COLOR, OR NATIONAL ORIGIN, BUT NOT SEX;
AND WHEREAS, SEX DISCRIMINATION IS CURRENTLY BANNED IN ANY EDUCATION PROGRAM OR ACTIVITY RECEIVING FEDERAL FINANCIAL ASSISTANCE UNDER TITLE IX OF THE FEDERAL EDUCATION AMENDMENTS OF 1972 (20 U.S.C. SEC. 1681 ET SEQ.); AND
WHEREAS, FEDERALLY FUNDED SENIOR SOCIAL SERVICE PROGRAMS CURRENTLY ALLOW GRANT RECIPIENT AGENCIES TO SERVE THE NEEDS OF MEN MORE THAN WOMEN, OR WOMEN MORE THAN MEN; NOW, THEREFORE, BE IT
RESOLVED, BY THE SENIOR ASSEMBLY AND THE SENIOR SENATE, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2011 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT THE CONGRESS AND THE PRESIDENT AMEND TITLE VI OF THE FEDERAL CIVIL RIGHTS ACT OF 1964 (42 U.S.C. SEC. 1981 ET SEQ.) TO BAN DISCRIMINATION ON THE BASIS OF SEX IN ANY PROGRAM OR ACTIVITY RECEIVING FEDERAL FINANCIAL ASSISTANCE; AND BE IT FURTHER
RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE CONGRESS AND THE PRESIDENT TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER
RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE PRESIDENT AND VICE PRESIDENT, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES, THE CHAIRPERSON OF THE HOUSE SUBCOMMITTEE ON THE CONSTITUTION, CIVIL RIGHTS, AND CIVIL LIBERTIES, THE CHAIRPERSON OF THE SENATE SUBCOMMITTEE ON THE CONSTITUTION, CIVIL RIGHTS, AND HUMAN RIGHTS, AND TO EACH SENATOR AND REPRESENTATIVE FROM CALIFORNIA IN THE CONGRESS OF THE UNITED STATES.
