SP 18: MOBILEHOMES: RULES AND REGULATIONS: NOTICE.

UNDER EXISTING LAW, WHEN THE MANAGEMENT OF A MOBILEHOME PARK PROPOSES AN AMENDMENT TO THE PARK’S RULES AND REGULATIONS THE MANAGEMENT IS REQUIRED TO MEET AND CONSULT WITH THE HOMEOWNERS IN THE PARK AND TO GIVE WRITTEN NOTICE TO THE HOMEOWNERS IN THE PARK AT LEAST 10 DAYS BEFORE THE MEETING.

THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD REQUIRE THE MANAGEMENT OF A MOBILEHOME PARK TO GIVE NOTICE TO HOMEOWNERS OF CHANGES TO INFORMAL POLICY AND PROCEDURES AND TO POST NOTICE OF CHANGES TO PARK RULES, REGULATIONS, POLICIES, AND PROCEDURES IN ALL COMMON AREAS, ENTRANCES, AND EXITS.

SP 18: RELATING TO MOBILEHOMES

WHEREAS, UNDER SECTION 798.25 OF THE CIVIL CODE WHEN THE MANAGEMENT OF A MOBILEHOME PARK PROPOSES A CHANGE TO THE PARK’S RULES AND REGULATIONS THEY ARE REQUIRED TO HOLD A MEETING TO MEET AND CONSULT WITH HOMEOWNERS; AND

WHEREAS, SECTION 798.25 OF THE CIVIL CODE ONLY PROVIDES WRITTEN NOTICE SHALL BE GIVEN 10 OR MORE DAYS BEFORE A MEETING WITH THE MANAGEMENT; AND

WHEREAS, THERE IS NO REQUIREMENT THAT ANY FORMAL NOTICE BE GIVEN WHEN MANAGEMENT MAKES A CHANGE TO THE PARK’S INFORMAL POLICIES AND PROCEDURES; AND

WHEREAS, SENIOR CITIZENS RESIDING AS HOMEOWNERS IN THE PARK MAY HAVE CONDITIONS LIMITING THEIR ABILITY TO UNDERSTAND OR COMPLY WITH CHANGES TO THE PARK’S INFORMAL POLICIES AND PROCEDURES; AND

WHEREAS, THIS FAILURE TO PROVIDE ADEQUATE AND VISIBLE NOTICE MAY CREATE HARDSHIP AND ILL FEELINGS BETWEEN HOMEOWNERS AND PARK MANAGEMENT; NOW, THEREFORE, BE IT

RESOLVED, BY THE SENIOR SENATE AND THE SENIOR ASSEMBLY, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2010 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT THE PARK MANAGEMENT SHALL ALSO PROVIDE NOTICE WHEN THERE ARE CHANGES TO THE PARK’S INFORMAL POLICIES AND PROCEDURES AND THAT NOTICE SHALL BE POSTED BY THE PARK MANAGEMENT IN ALL PARK COMMON AREAS, ENTRANCES, AND EXITS WHEN THERE IS ANY CHANGE TO ANY RULE, REGULATION, POLICY, OR PROCEDURE; AND BE IT FURTHER

RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER

RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE PRESIDENT PRO TEMPORE OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, AND THE GOVERNOR OF THE STATE OF CALIFORNIA.
