AP 43: SENIOR HOUSING
EXISTING LAW REQUIRES THE INSPECTION AND LICENSURE OF RESIDENTIAL CARE FACILITIES FOR THE ELDERLY, AS SPECIFIED.
THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE
GOVERNOR TO ENACT LEGISLATION THAT WOULD REQUIRE THE DEPARTMENT OF HEALTH AND
HUMAN SERVICES IN EACH COUNTY TO COORDINATE A TRAINING PROGRAM FOR UNLICENSED
SENIOR AND DISABLED RENTAL HOUSING MANAGERS AND TO CONFER A CERTIFICATE OF COMPLETION UPON
EACH ATTENDEE.

AP 44: RELATING TO SENIOR AND DISABLED HOUSING
WHEREAS, AGING SENIORS AND DISABLED HAVE SPECIAL NEEDS THAT REQUIRE PROTECTION THROUGH PUBLIC AWARENESS AND EDUCATION; AND
WHEREAS, THE STATE OF CALIFORNIA REQUIRES MANDATORY EDUCATION AND TRAINING FOR ITS LICENSED SENIOR RESIDENTIAL AND CARE FACILITIES; AND
WHEREAS, THERE IS NO CURRENT REQUIREMENT FOR ANY MINIMAL TRAINING FOR UNLICENSED SENIOR AND DISABLED RENTAL HOUSING MANAGERS; AND
WHEREAS, EXISTING STATE AGENCIES CURRENTLY REGULATE AND STUDY SENIOR ISSUES, INCLUDING PHYSICAL AND PSYCHOLOGICAL HEALTH ISSUES AND ELDER ABUSE AND PROTECTION; AND
WHEREAS, THE STATE DEPARTMENT OF SOCIAL SERVICES AND THE DEPARTMENT OF HEALTH AND HUMAN SERVICES IN EACH COUNTY OVERSEE ADULT PROTECTIVE SERVICES; AND
WHEREAS, UNLICENSED SENIOR AND DISABLED RENTAL HOUSING MANAGERS ARE DEFICIENT IN THE SPECIALIZED TRAINING AND KNOWLEDGE NECESSARY TO ENSURE THE HEALTH, SAFETY, AND WELFARE OF THEIR SENIOR RESIDENTS; AND
WHEREAS, THE DEPARTMENT OF HEALTH AND HUMAN SERVICES IN EACH COUNTY CAN BEST IMPART THIS TRAINING AND KNOWLEDGE; NOW, THEREFORE, BE IT
RESOLVED, BY THE SENIOR ASSEMBLY AND THE SENIOR SENATE, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2010 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT ALL RESIDENCES THAT HOUSE SENIORS AND THE DISABLED, EXCLUDING SINGLE FAMILY RESIDENCES, RESIDENCES LICENSED BY THE STATE, AND HOMES HOUSING FEWER THAN SEVEN SENIORS OR THE DISABLED, REQUIRE THE MANAGERS TO ATTEND AN INITIAL TRAINING AND SUBSEQUENT TRAINING EVERY FIVE YEARS, AND TO DISPLAY A CURRENT CERTIFICATE OF COMPLETION IN THE OFFICE OF EACH MANAGER; AND BE IT FURTHER RESOLVED,
THAT THE DEPARTMENT OF HEALTH AND HUMAN SERVICES IN EACH COUNTY OF THE STATE SHALL COORDINATE TRAINING PROGRAMS FOR UNLICENSED SENIOR OR DISABLED RENTAL HOUSING MANAGERS CONSISTING OF NOT LESS THAN EIGHT HOURS AND THAT A FEE BE IMPOSED ON PROPERTY OWNERS TO PAY FOR THE PROGRAM AND SHALL CONFER A CERTIFICATE OF COMPLETION UPON EACH ATTENDEE. THE TRAINING MAY INCLUDE BASIC FIRST AID, FIRE SAFETY, SENSITIVITY TO SENIOR NEEDS AND HEALTH ISSUES, ELDER ABUSE RECOGNITION AND PROTECTION, AND EDUCATION AND INFORMATION AS TO AVAILABLE SENIOR COMMUNITY RESOURCES IN THE COUNTY AND THE STATE, AS DETERMINED TO BE APPROPRIATE BY EACH COUNTY; AND BE IT FURTHER
RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER
RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO
THE SPEAKER OF THE ASSEMBLY, THE PRESIDENT PRO TEMPORE OF THE SENATE, AND THE
GOVERNOR OF THE STATE OF CALIFORNIA.
