AP 28: MARKED SENIOR CROSSWALKS

EXISTING LAW PROVIDES FOR THE PLACEMENT AND REGULATION OF MARKED PEDESTRIAN CROSSWALKS ON STREETS AND HIGHWAYS. EXISTING LAW PROVIDES FOR THE LICENSING AND REGULATION OF CARE FACILITIES.

THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD REQUIRE THE ESTABLISHMENT OF MARKED SENIOR CROSSWALKS CONVENIENTLY LOCATED ON STREETS OR HIGHWAYS NEAR FACILITIES THAT PROVIDE CARE OR SERVICES FOR SENIORS.

AP 28: RELATING TO MARKED SENIOR CROSSWALKS

WHEREAS, HISTORICALLY, SENIORS ARE PHYSICALLY SLOWER AND NEED MORE TIME TO SAFELY CROSS INTERSECTIONS THAN DO YOUNGER PEDESTRIANS; AND

WHEREAS, DRIVERS, INTENT ON REACHING THEIR DESTINATION, CAN BE DISTRACTED, THUS PRESENTING A DANGER TO SENIOR PEDESTRIANS; AND

WHEREAS, SENIORS IN CARE FACILITIES ARE ENCOURAGED TO LIVE AS INDEPENDENTLY AS POSSIBLE AND TO VENTURE OUT INTO THE COMMUNITY AND PARTICIPATE IN SOCIAL AND OTHER ACTIVITIES; AND

WHEREAS, DRIVERS SHOULD BE ALERTED AS THEY APPROACH A CROSSWALK FREQUENTED BY SENIORS SO THAT THEY MAY TAKE THE NECESSARY CAUTION TO AVOID INJURY; AND

WHEREAS, THE ESTABLISHMENT OF MARKED SENIOR CROSSWALKS CONVENIENTLY LOCATED ON STREETS AND HIGHWAYS NEAR FACILITIES PROVIDING CARE OR SERVICES FOR SENIORS WOULD SERVE AS A HELPFUL REMINDER FOR DRIVERS AND WOULD GREATLY IMPROVE TRAFFIC SAFETY FOR THOSE SENIORS; NOW THEREFORE, BE IT

RESOLVED, BY THE SENIOR ASSEMBLY AND THE SENIOR SENATE, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2009 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT MARKED SENIOR CROSSWALKS BE ESTABLISHED AT CONVENIENT LOCATIONS ON STREETS OR HIGHWAYS NEAR FACILITIES THAT PROVIDE CARE OR SERVICES FOR SENIORS, INCLUDING BUT NOT LIMITED TO, SENIOR RESIDENTIAL COMPLEXES, SENIOR CENTERS, AND DESIGNATED SENIOR NUTRITIONAL AND DINING SITES SO THAT DRIVERS ARE ALERTED TO THE LIKELY PRESENCE OF SENIOR PEDESTRIANS; AND BE IT FURTHER

RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER

RESOLVED, THAT FEDERAL STIMULUS DOLLARS BE CONSIDERED AS A POTENTIAL FUNDING SOURCE FOR THIS PROPOSAL; AND BE IT FURTHER RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE SPEAKER OF THE ASSEMBLY, THE PRESIDENT PRO TEMPORE OF THE SENATE, AND THE GOVERNOR OF THE STATE OF CALIFORNIA.
