SENIOR SENATE FEDERAL PROPOSAL NO. 5

SFP 5: PRESCRIPTION DRUG SAFETY.
FEDERAL LAW REQUIRES THAT THE FEDERAL DRUG ADMINISTRATION REGULATE, AND ENSURE THE SAFETY OF, PRESCRIPTION DRUGS AVAILABLE FOR USE AND SALE IN THE UNITED STATES.
THIS MEASURE WOULD MEMORIALIZE THE CONGRESS AND THE PRESIDENT TO ENACT LEGISLATION THAT WOULD REQUIRE THE FEDERAL DRUG ADMINISTRATION (FDA) TO CONSULT WITH THE UNITED STATES SENATE COMMITTEE ON HEALTH, EDUCATION, LABOR, AND PENSIONS TO DETERMINE THE BEST METHODS OF ENSURING PRESCRIPTION DRUG SAFETY, INCLUDING THE ESTABLISHMENT OF PROTOCOLS FOR WITHDRAWALS FROM THOSE DRUGS, AND ANALYZE WHETHER ADDITIONAL LAWS AND REGULATIONS SHOULD BE ENACTED TO BETTER PROVIDE FOR INCREASED PRESCRIPTION DRUG SAFETY.

SFP 5: RELATING TO PRESCRIPTION DRUG SAFETY
WHEREAS, IN THE UNITED STATES, AT LEAST 135,000 PEOPLE DIE FROM TAKING AN INDUSTRY RESEARCHED, FEDERAL DRUG ADMINISTRATION (FDA) APPROVED PRESCRIPTION DRUG; AND
WHEREAS, CONGRESS, WHICH IS RESPONSIBLE FOR OVERSEEING THE FDA, HAS FAILED TO ADEQUATELY MONITOR THE OPERATION OF THE AGENCY; NOW, THEREFORE, BE IT
RESOLVED, BY THE SENIOR SENATE AND THE SENIOR ASSEMBLY, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2008 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT THE CONGRESS AND THE PRESIDENT BE MEMORIALIZED TO ENACT LEGISLATION THAT WOULD REQUIRE THE FDA TO CONSULT WITH THE UNITED STATES SENATE COMMITTEE ON HEALTH, EDUCATION, LABOR, AND PENSIONS TO DETERMINE THE BEST METHODS OF ENSURING PRESCRIPTION DRUG SAFETY, INCLUDING THE BANNING OF ADVERTISEMENTS ON TELEVISION, RADIO, AND PRINT RELATING TO PRESCRIPTION DRUGS, THE ESTABLISHMENT OF PROTOCOLS FOR PATIENT WITHDRAWALS FROM THOSE DRUGS, AND ANALYZE WHETHER ADDITIONAL LAWS AND REGULATIONS SHOULD BE ENACTED TO BETTER PROVIDE FOR INCREASED PRESCRIPTION DRUG SAFETY; AND BE IT FURTHER
RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE CONGRESS AND THE PRESIDENT TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER
RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE PRESIDENT AND VICE PRESIDENT, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES, THE CHAIRPERSONS OF THE HOUSE AND SENATE COMMITTEES ON AGING, AND TO EACH SENATOR AND REPRESENTATIVE FROM CALIFORNIA IN THE CONGRESS OF THE UNITED STATES.
