SENIOR ASSEMBLY PROPOSAL NO. 18
INTRODUCED BY SENIOR ASSEMBLY MEMBER WOLFE
LEGISLATIVE COUNSEL'S DIGEST
AP 18: CAREGIVERS.
UNDER EXISTING LAW, QUALIFIED AGED, BLIND, AND DISABLED PERSONS ARE PROVIDED WITH SERVICES TO PERMIT THEM TO REMAIN IN THEIR OWN HOMES AND AVOID INSTITUTIONALIZATION THROUGH THE COUNTY-ADMINISTERED IN-HOME SUPPORTIVE SERVICES (IHSS) PROGRAM. EXISTING LAW PERMITS SERVICES TO BE PROVIDED UNDER THE IHSS PROGRAM EITHER THROUGH THE EMPLOYMENT OF INDIVIDUAL PROVIDERS, A CONTRACT BETWEEN THE COUNTY AND AN ENTITY FOR THE PROVISION OF SERVICES, THE CREATION BY THE COUNTY OF A PUBLIC AUTHORITY, OR A CONTRACT BETWEEN THE COUNTY AND A NONPROFIT CONSORTIUM.
EXISTING LAW ALSO PROVIDES FOR THE MEDI-CAL PROGRAM, WHICH IS ADMINISTERED BY THE STATE DEPARTMENT OF HEALTH CARE SERVICES, PURSUANT TO WHICH DESIGNATED MEDICAL BENEFITS ARE PROVIDED TO PUBLIC ASSISTANCE RECIPIENTS AND CERTAIN OTHER LOW-INCOME PERSONS. UNDER EXISTING LAW, CERTAIN MEDI-CAL RECIPIENTS ARE ENTITLED TO RECEIVE PERSONAL CARE SERVICES, AS DEFINED, WHICH ARE RENDERED IN THE MANNER AUTHORIZED UNDER THE IHSS PROGRAM, BUT PAID FOR BY THE MEDI-CAL PROGRAM. UNDER EXISTING LAW, IHSS SERVICES ARE ALSO A COVERED MEDI-CAL BENEFIT PURSUANT TO THE AUTHORITY OF THE FEDERAL IHSS-PLUS WAIVER.
THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD REQUIRE THAT ALL UNLICENSED OR UNCERTIFIED INDIVIDUALS PROVIDING CARE AND SUPPORTIVE SERVICES TO ELDERS, DEPENDENT ADULTS, OR OTHER ADULTS REQUIRING SUPPORTIVE SERVICES BE CERTIFIED BY THE STATE.
VOTE: MAJORITY.
