SP 18: MELLO-GRANLUND OLDER CALIFORNIANS ACT.
UNDER EXISTING LAW, THE MELLO-GRANLUND OLDER CALIFORNIANS ACT ESTABLISHES VARIOUS PROGRAMS THAT SERVE OLDER INDIVIDUALS, INCLUDING THOSE WHO ARE DISABLED.
THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD AMEND THE MELLO-GRANLUND OLDER CALIFORNIANS ACT TO DEFINE DISABILITY.

SP 18: RELATING TO THE MELLO-GRANLUND OLDER CALIFORNIANS ACT
WHEREAS, THE MELLO-GRANLUND OLDER CALIFORNIANS ACT (DIVISION 8.5 (COMMENCING WITH SECTION 9000) OF THE WELFARE AND INSTITUTIONS CODE) DOES NOT DEFINE DISABILITY; AND
WHEREAS, A SIGNIFICANT NUMBER OF CALIFORNIA SENIORS HAVE A DISABILITY; AND
WHEREAS, DISABILITY IS DEFINED IN THE CALIFORNIA FAIR HOUSING AND EMPLOYMENT ACT (PART 2.8 (COMMENCING WITH SECTION 12926) OF DIVISION 3 OF THE GOVERNMENT CODE) AND IS BROADER THAN THE DEFINITION OF DISABILITY PROVIDED FOR UNDER THE FEDERAL OLDER AMERICANS ACT (CHAPTER 35 (COMMENCING WITH SECTION 3001) OF TITLE 42 OF THE UNITED STATES CODE); AND
WHEREAS, THE PROTECTION PROVIDED UNDER CALIFORNIA LAW IS GREATER THAN THAT PROVIDED UNDER FEDERAL LAW; NOW, THEREFORE, BE IT
RESOLVED, BY THE SENIOR SENATE AND THE SENIOR ASSEMBLY, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2007 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT THE MELLO-GRANLUND OLDER CALIFORNIANS ACT (DIVISION 8.5 (COMMENCING WITH SECTION 9000) OF THE WELFARE AND INSTITUTIONS CODE) BE AMENDED TO DEFINE DISABILITY AS SET FORTH IN SECTION 12926 OF THE GOVERNMENT CODE; AND BE IT FURTHER
RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER
RESOLVED; THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE PRESIDENT PRO TEMPORE OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, AND THE GOVERNOR OF THE STATE OF CALIFORNIA.
