SP 15: DISABLED PARKING VIOLATIONS: FINES.

UNDER EXISTING LAW, A COUNTY IS AUTHORIZED TO IMPOSE AN ASSESSMENT FOR EVERY FINE, FORFEITURE, OR PARKING PENALTY IMPOSED FOR VEHICLES UNLAWFULLY PARKED IN SPACES DESIGNATED FOR DISABLED PERSONS. EXISTING LAW REQUIRES A COUNTY TO USE THE FUNDS COLLECTED FROM THE ASSESSMENT FOR CERTAIN COMMUNITY-BASED SERVICES PROGRAMS, INCLUDING THE LINKAGES PROGRAM.

THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD REQUIRE EACH COUNTY TO IMPOSE AN ASSESSMENT FOR EVERY FINE, FORFEITURE, OR PARKING PENALTY FOR VEHICLES UNLAWFULLY PARKED IN SPACES DESIGNATED FOR DISABLED PERSONS, FOR THE PURPOSE OF FUNDING COMMUNITY-BASED SERVICES PROGRAMS FOR SENIORS, INCLUDING THE LINKAGES PROGRAM.  THE MEASURE WOULD ALSO MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD ENSURE THAT EACH AREA AGENCY ON AGING EXPLORE ADDITIONAL SOURCES OF FINANCIAL SUPPORT FOR SENIOR PROGRAMS.

SP 15: RELATING TO DISABLED PARKING VIOLATIONS: FINES

WHEREAS, THE PURPOSE OF THE LINKAGES PROGRAM IS TO PROVIDE CARE AND CASE MANAGEMENT SERVICES TO FRAIL ELDERLY AND FUNCTIONALLY IMPAIRED ADULTS TO HELP PREVENT OR DELAY PLACEMENT IN NURSING FACILITIES; AND

WHEREAS, THE STATE OF CALIFORNIA IS DIVIDED INTO THIRTY-THREE AREA AGENCIES ON AGING, WHICH SUPPORT THIRTY-EIGHT LINKAGES PROGRAM SITES FOR FRAIL ELDERLY AND FUNCTIONALLY IMPAIRED ADULTS; AND

WHEREAS, EXISTING LAW AUTHORIZES COUNTIES TO IMPOSE AN ASSESSMENT FOR EVERY FINE, FORFEITURE, OR PARKING PENALTY FOR DISABLED PARKING VIOLATIONS, FOR THE PURPOSE OF FUNDING COMMUNITY-BASED SERVICES PROGRAMS, INCLUDING THE LINKAGES PROGRAM; AND

WHEREAS, IN 2002, ONLY SIX LINKAGES PROGRAM SITES RECEIVED FUNDING FROM FINES FOR DISABLED PARKING VIOLATIONS, ACCORDING TO A SURVEY CONDUCTED BY THE LINKAGES SITE ASSOCIATION; NOW, THEREFORE, BE IT

RESOLVED, BY THE SENIOR SENATE AND THE SENIOR ASSEMBLY, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2006 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT EACH COUNTY BE REQUIRED TO IMPOSE AN ASSESSMENT FOR EVERY FINE, FORFEITURE, OR PARKING PENALTY FOR VEHICLES UNLAWFULLY PARKED IN SPACES DESIGNATED FOR DISABLED PERSONS, FOR THE PURPOSE OF FUNDING COMMUNITY-BASED SERVICES PROGRAMS FOR SENIORS, INCLUDING THE LINKAGES PROGRAM; AND BE IT FURTHER

RESOLVED, THAT EACH AREA AGENCY ON AGING EXPLORE ADDITIONAL SOURCES OF FINANCIAL SUPPORT FOR SENIOR PROGRAMS; AND BE IT FURTHER

RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER

RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE SPEAKER OF THE ASSEMBLY, THE PRESIDENT PRO TEMPORE OF THE SENATE, AND THE GOVERNOR OF THE STATE OF CALIFORNIA.
