LEGISLATIVE COUNSEL’S DIGEST

SFP 4: AUTOMOBILE SAFETY.

UNDER EXISTING LAW, AUTOMOBILE MANUFACTURERS ARE REQUIRED TO COMPLY WITH VARIOUS AUTOMOBILE MANUFACTURING STANDARDS PRESCRIBED BY THE SECRETARY OF TRANSPORTATION, FOR THE PURPOSE OF IMPROVING AUTOMOBILE SAFETY AND REDUCING TRAFFIC ACCIDENTS.

THIS MEASURE WOULD MEMORIALIZE THE CONGRESS AND THE PRESIDENT TO ENACT LEGISLATION THAT WOULD REQUIRE AUTOMOBILE MANUFACTURERS TO EQUIP ANY NEW AUTOMOBILE MANUFACTURED OR SOLD IN THE UNITED STATES WITH AN AUTOMATIC HEADLIGHT DEVICE THAT IMMEDIATELY ILLUMINATES THE AUTOMOBILE’S HEADLIGHTS WHEN THE WINDSHIELD WIPERS ARE ACTIVATED.

SFP 4: RELATING TO AUTOMOBILE SAFETY

WHEREAS, AUTOMOBILE MANUFACTURERS ARE CURRENTLY MANUFACTURING SOME AUTOMOBILES THAT AUTOMATICALLY ILLUMINATE AN AUTOMOBILE’S HEADLIGHTS WHEN THE AUTOMOBILE’S IGNITION IS TURNED ON; AND

WHEREAS, RESEARCH STUDIES HAVE INDICATED THAT FEWER AUTOMOBILE ACCIDENTS OCCUR WHEN AN AUTOMOBILE’S HEADLIGHTS ARE ILLUMINATED; AND

WHEREAS, THE STATES OF CALIFORNIA AND NEW JERSEY, AMONG OTHERS, HAVE ENACTED LEGISLATION REQUIRING AUTOMOBILE DRIVERS TO TURN ON THEIR HEADLIGHTS WHEN THE WINDSHIELD WIPERS IN AN AUTOMOBILE ARE ACTIVATED, WHICH HAS RESULTED IN A DECREASE IN THE TOTAL NUMBER OF AUTOMOBILE ACCIDENTS IN THOSE STATES; NOW, THEREFORE, BE IT

RESOLVED, BY THE SENIOR SENATE AND THE SENIOR ASSEMBLY, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2006 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT AUTOMOBILE MANUFACTURERS BE REQUIRED TO EQUIP ANY NEW AUTOMOBILE MANUFACTURED OR SOLD IN THE UNITED STATES WITH AN AUTOMATIC HEADLIGHT DEVICE THAT IMMEDIATELY ILLUMINATES AN AUTOMOBILE’S HEADLIGHTS WHEN THE WINDSHIELD WIPERS ARE ACTIVATED; AND BE IT FURTHER

RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE CONGRESS AND THE PRESIDENT TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER

RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE PRESIDENT AND VICE PRESIDENT, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES, THE CHAIRPERSONS OF THE HOUSE AND SENATE COMMITTEES ON AGING, AND TO EACH SENATOR AND REPRESENTATIVE FROM CALIFORNIA IN THE CONGRESS OF THE UNITED STATES.
