LEGISLATIVE COUNSEL’S DIGEST

AP 8: DISABLED PARKING.

UNDER EXISTING LAW, A DISABLED PERSON DISPLAYING SPECIAL LICENSE PLATES OR A DISTINGUISHING PLACARD ISSUED BY THE DEPARTMENT OF MOTOR VEHICLES IS ALLOWED TO PARK FOR UNLIMITED PERIODS IN CERTAIN PARKING ZONES AND DESIGNATED PARKING PLACES OR STALLS.

THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD INCREASE THE NUMBER OF DISABLED PARKING SPACES IN EACH PARKING LOT OR GARAGE, AS SPECIFIED, TO ACCOMMODATE THE GROWING SENIOR AND DISABLED POPULATION.

AP 8: RELATING TO DISABLED PARKING

WHEREAS, BETWEEN 1996, WHEN THE POPULATION OF CALIFORNIA WAS 31,962,000 AND 1,044,421 DISABLED PLACARDS WERE ISSUED, AND 2004, WHEN THE POPULATION OF CALIFORNIA WAS 35,591,000 AND 1,737,743 DISABLED PLACARDS WERE ISSUED, THERE WAS AN INCREASE OF 693,322 ISSUED PLACARDS. THIS FIGURE REPRESENTS AN INCREASE OF 48.8 PERCENT; AND

WHEREAS, THE SENIOR POPULATION OF CALIFORNIA FOR THE NEXT THREE DECADES IS EXPECTED TO INCREASE FROM 14.0553 PERCENT OF THE TOTAL POPULATION OF CALIFORNIA IN 2000 TO 16.33 PERCENT IN 2010, 19.93 PERCENT IN 2020, AND 22.83 PERCENT IN 2030. THESE INCREASES REFLECT THE “BABY BOOM” GENERATION’S RETIREMENT AND BRING WITH THEM A GREATER NEED FOR MORE AVAILABLE PARKING FOR THE DISABLED AND FRAIL ELDERLY; AND

WHEREAS, THE PERCENTAGE OF SENIORS (THOSE PERSONS AGE 60 YEARS AND OLDER) OF THE TOTAL POPULATION OF THE UNITED STATES IS PREDICTED TO BE 16.8 PERCENT IN 2005 AND 26 PERCENT IN 2050, AN INCREASE OF 10 PERCENT, THE NUMBER OF DISABLED PARKING SPACES MUST BE INCREASED TO MEET THE INCREASE IN THE SENIOR AND DISABLED POPULATION; NOW, THEREFORE, BE IT

RESOLVED, BY THE SENIOR ASSEMBLY AND THE SENIOR SENATE, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2006 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT THE NUMBER OF DISABLED PARKING SPACES IN EACH PARKING LOT OR GARAGE AT HOSPITALS AND MEDICAL FACILITIES BE INCREASED BY ONE PARKING SPACE PER LOT PER YEAR, OR BY 1 PERCENT EACH YEAR, WHICHEVER IS GREATER, UNTIL A 10 PERCENT INCREASE OVER THE CURRENT LEVEL HAS BEEN ACHIEVED, TO ACCOMMODATE THE EVER-GROWING SENIOR AND DISABLED POPULATION; AND BE IT FURTHER

RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER

RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE SPEAKER OF THE ASSEMBLY, THE PRESIDENT PRO TEMPORE OF THE SENATE, AND THE GOVERNOR OF THE STATE OF CALIFORNIA.
