AP 5: LOW-INCOME HOUSING FOR SENIORS.
UNDER EXISTING LAW, THE COMMUNITY REDEVELOPMENT LAW, NOT LESS THAN 20 PERCENT OF SPECIFIED TAX REVENUE IS REQUIRED TO BE ALLOCATED TO A REDEVELOPMENT AGENCY TO BE USED FOR PURPOSES OF INCREASING, IMPROVING, AND PRESERVING THE COMMUNITY’S SUPPLY OF LOW- AND MODERATE-INCOME HOUSING, WITH CERTAIN EXCEPTIONS. EXISTING LAW REQUIRES THESE FUNDS TO BE DEPOSITED IN A SEPARATE LOW AND MODERATE INCOME HOUSING FUND. EXISTING LAW REQUIRES EACH REDEVELOPMENT AGENCY TO EXPEND, OVER THE DURATION OF ITS REDEVELOPMENT IMPLEMENTATION PLAN, THE MONEYS IN THE LOW AND MODERATE INCOME HOUSING FUND TO ASSIST HOUSING THAT IS AVAILABLE TO ALL PERSONS REGARDLESS OF AGE IN AT LEAST THE SAME PROPORTION AS THE NUMBER OF LOW-INCOME HOUSEHOLDS WITH A MEMBER UNDER AGE 65 YEARS BEARS TO THE TOTAL NUMBER OF LOW-INCOME HOUSEHOLDS OF THE COMMUNITY.
THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD AMEND THE PROVISIONS DESCRIBED ABOVE TO REQUIRE A REDEVELOPMENT AGENCY TO EXPEND A MINIMUM OF 11 PERCENT OF THE MONEYS IN THE LOW AND MODERATE INCOME HOUSING FUND TO ASSIST HOUSING THAT IS AVAILABLE TO LOW- AND MODERATE-INCOME HOUSEHOLDS WITH A MEMBER AGE 65 OR OVER, UNLESS THE PROPORTION OF LOW AND MODERATE-INCOME HOUSEHOLDS WITH A MEMBER AGE 65 OR OVER IN THE COMMUNITY IS GREATER THAN 11 PERCENT, IN WHICH CASE THE REDEVELOPMENT AGENCY WOULD BE REQUIRED TO EXPEND THE MONEYS IN THE LOW AND MODERATE INCOME HOUSING FUND TO ASSIST HOUSING THAT IS AVAILABLE TO LOW AND MODERATE-INCOME INDIVIDUALS AGE 65 OR OVER IN THE PROPORTION THAT THESE INDIVIDUALS BEAR TO THE TOTAL POPULATION IN THE COMMUNITY OR JURISDICTION.

AP 5: RELATING TO LOW-INCOME HOUSING FOR SENIORS
WHEREAS, EXISTING LAW, THE COMMUNITY REDEVELOPMENT LAW, REQUIRES THAT FUNDS BE ALLOCATED TO INCREASE, IMPROVE, AND PRESERVE A COMMUNITY’S SUPPLY OF LOW- AND MODERATE-INCOME HOUSING; AND
WHEREAS, IN 2000, PERSONS AGE 65 OR OVER REPRESENTED APPROXIMATELY 11 PERCENT OF CALIFORNIA’S POPULATION, ACCORDING TO THE UNITED STATES CENSUS BUREAU; AND
WHEREAS, BY THE YEAR 2020, THE POPULATION OF SENIORS WILL INCREASE BY AS MUCH AS 150 PERCENT IN SOME PARTS OF THE STATE, ACCORDING TO THE CALIFORNIA DEPARTMENT OF AGING, AND BY THE YEAR 2030, THE NUMBER OF SENIORS OVER AGE 65 WILL DOUBLE IN THE STATE TO ONE IN EVERY SIX CALIFORNIANS, ACCORDING TO THE PUBLIC POLICY INSTITUTE OF CALIFORNIA; AND
WHEREAS, SENIORS REPRESENT A LARGE PERCENTAGE OF VERY LOW, LOW, AND MODERATE INCOME HOUSEHOLDS IN THE STATE; AND
WHEREAS, EXISTING LAW DOES NOT ESTABLISH A MINIMUM PERCENTAGE OF LOW- AND MODERATE-INCOME HOUSING FUNDS REQUIRED TO BE SET ASIDE FOR SENIORS AGE 65 OR OVER; AND
WHEREAS, THIS MEASURE WOULD SUPPORT THE ADDITION OF A PROVISION TO THE HEALTH AND SAFETY CODE THAT WOULD REQUIRE THAT A MINIMUM OF 11 PERCENT OF THE MONEYS FOR LOW- AND MODERATE-INCOME HOUSING IN THE LOW AND MODERATE INCOME HOUSING FUND BE ALLOCATED FOR THE PURPOSE OF PROVIDING LOW-INCOME HOUSING FOR HOUSEHOLDS OCCUPIED BY A MEMBER AGE 65 OR OVER; NOW, THEREFORE, BE IT
RESOLVED, BY THE SENIOR ASSEMBLY AND THE SENIOR SENATE, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2006 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT THE HEALTH AND SAFETY CODE BE AMENDED TO REQUIRE A REDEVELOPMENT AGENCY TO EXPEND A MINIMUM OF 11 PERCENT OF THE MONEYS IN THE LOW AND MODERATE INCOME HOUSING FUND TO ASSIST HOUSING THAT IS AVAILABLE TO LOW AND MODERATE-INCOME HOUSEHOLDS WITH A MEMBER AGE 65 OR OVER, UNLESS THE PROPORTION OF LOW AND MODERATE-INCOME HOUSEHOLDS IN THE COMMUNITY WITH A MEMBER AGE 65 OR OVER IS GREATER THAN 11 PERCENT, IN WHICH CASE THE REDEVELOPMENT AGENCY WOULD BE REQUIRED TO EXPEND THE MONEYS IN THE LOW AND MODERATE INCOME HOUSING FUND TO ASSIST HOUSING THAT IS AVAILABLE TO LOW AND MODERATE-INCOME INDIVIDUALS AGE 65 AND OVER IN THE PROPORTION THAT THOSE INDIVIDUALS BEAR TO THE TOTAL POPULATION IN THE COMMUNITY OR JURISDICTION AND BE IT FURTHER
RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER
RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE SPEAKER OF THE ASSEMBLY, THE PRESIDENT PRO TEMPORE OF THE SENATE, AND THE GOVERNOR OF THE STATE OF CALIFORNIA.
