SFP 2: SOCIAL SECURITY
EXISTING FEDERAL LAW GOVERNS THE PAYMENT OF SOCIAL SECURITY BENEFITS.
THIS MEASURE WOULD MEMORIALIZE THE CONGRESS AND THE PRESIDENT TO ENACT LEGISLATION WHICH WOULD RESTORE FULL SOCIAL SECURITY BENEFITS TO VARIOUS RECIPIENTS BY REPEALING THE SOCIAL SECURITY GOVERNMENT PENSION OFFSET AND WINDFALL ELIMINATION PROVISION OF FEDERAL LAW.
VOTE: MAJORITY.
SFP 2: RELATING TO THE SOCIAL SECURITY GOVERNMENT PENSION OFFSET AND WINDFALL ELIMINATION PROVISION OF SOCIAL SECURITY LAW.
WHEREAS, FIVE HUNDRED THOUSAND FEDERAL, STATE, AND LOCAL WORKERS AND THEIR DEPENDENTS ARE PENALIZED UP TO 60 PERCENT OF THEIR SOCIAL SECURITY BENEFITS IN 15 STATES, INCLUDING CALIFORNIA, UNDER THE WINDFALL ELIMINATION PROVISION OF SOCIAL SECURITY LAW; AND
WHEREAS, THREE HUNDRED THOUSAND SPOUSES OF FEDERAL, STATE, AND LOCAL WORKERS AND SURVIVORS ARE PENALIZED FROM 66 PERCENT TO 100 PERCENT OF THE WORKER'S SOCIAL SECURITY BENEFITS IN 15 STATES, INCLUDING CALIFORNIA, UNDER THE SOCIAL SECURITY GOVERNMENT PENSION OFFSET; NOW, THEREFORE, BE IT
RESOLVED, BY THE SENIOR SENATE AND THE SENIOR ASSEMBLY, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2003 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT THE PRESIDENT AND CONGRESS OF THE UNITED STATES REPEAL THE GOVERNMENT PENSION OFFSET AND WINDFALL ELIMINATION PROVISIONS OF THE SOCIAL SECURITY LAW, IN 15 STATES, INCLUDING CALIFORNIA; AND BE IT FURTHER
RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE CONGRESS AND THE PRESIDENT TO ENACT HOUSE RESOLUTION 594, INTRODUCED BY REPRESENTATIVE HOWARD "BUCK" MCKEON AND SENATE BILL 349, INTRODUCED BY SENATOR DIANNE FEINSTEIN, WHICH WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER
RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE PRESIDENT AND VICE PRESIDENT, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES, THE CHAIRPERSONS OF THE HOUSE AND SENATE COMMITTEES ON AGING AND TO EACH SENATOR AND REPRESENTATIVE FROM CALIFORNIA IN THE CONGRESS OF THE UNITED STATES.
