16: CONGREGATE HOUSING FOR THE
ELDERLY.
UNDER
EXISTING LAW, "CONGREGATE HOUSING FOR THE ELDERLY" MEANS A HOUSING
DEVELOPMENT, WHICH IS PLANNED, DESIGNED, AND MANAGED TO INCLUDE FACILITIES AND
COMMON SPACE THAT ALLOW FOR DIRECT SERVICES AND SUPPORT SERVICES THAT MAXIMIZE
THE RESIDENTS' POTENTIAL FOR INDEPENDENT LIVING.
THIS
MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION
THAT WOULD ALLOW CONGREGATE HOUSING FOR THE ELDERLY TO BE COUNTED TOWARDS A
VOTE:
MAJORITY.
AP 16:
RELATING TO HOUSING
WHEREAS,
THE 2000 UNITED STATES CENSUS INDICATES THAT SENIOR CITIZENS ARE EXPECTED TO BE
THE LARGEST GROWING POPULATION GROUP IN THE UNITED STATES AND IN CALIFORNIA FOR
THE NEXT TWO DECADES; AND WHEREAS,
THERE IS CURRENTLY A RECOGNIZED SHORTAGE OF HOUSING IN THE STATE OF CALIFORNIA,
INCLUDING AFFORDABLE AMD ACCESSIBLE HOUSING FOR SENIOR CITIZENS AND PERSONS WITH
DISABILITIES; AND
WHEREAS,
THE PROVISION OF SENIOR HOUSING THROUGHOUT
WHEREAS,
THE STATE OF CALIFORNIA REQUIRES ALL CITIES AND COUNTIES TO PREPARE GENERAL
PLANS FOR THE FUTURE DEVELOPMENT OF THEIR RESPECTIVE JURISDICTIONS, INCLUDING
HOUSING ELEMENTS; AND
WHEREAS,
LOCAL HOUSING ELEMENTS ARE REQUIRED BY STATE LAW TO MAKE PROVISIONS FOR FUTURE
HOUSING NEEDS, INCLUDING THE NEEDS OF LOW-INCOME SENIOR CITIZENS AND PERSONS
WITH DISABILITIES; AND
WHEREAS,
IN PLANNING FOR FUTURE NEEDS, HOUSING ELEMENTS MUST IDENTIFY THE LOCAL
"FAIR SHARE" OF FUTURE GROWTH, REPRESENTED AS A SPECIFIC NUMBER OF
UNITS AT VARIOUS INCOME LEVELS, AND MAKE PROVISIONS FOR THE DEVELOPMENT OF THESE
UNITS WITHIN A REASONABLE TIME PERIOD; AND
WHEREAS,
IN REVIEWING LOCAL HOUSING ELEMENTS FOR COMPLIANCE WITH STATE LAW, THE
DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT DOES NOT ALLOW CONGREGATE CARE
HOUSING FOR THE ELDERLY TO BE COUNTED TOWARD A COUNTY OR CITY'S "FAIR
SHARE" OF FUTURE HOUSING NEEDS; AND
WHEREAS,
CONGREGATE HOUSING OFFERS INDEPENDENT LIVING IN SEPARATE APARTMENTS, AND
OPPORTUNITIES TO SHARE ACTIVITIES AND DAILY LIVING WITH OTHER RESIDENTS, AND
THEY MAY BE RENTAL OR OWNERSHIP UNITS; AND
WHEREAS,
BY NOT COUNTING CONGREGATE HOUSING FOR THE ELDERLY IN LOCAL HOUSING ELEMENTS,
THE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT LIMITS CITIES AND COUNTIES
FROM DIRECTING RESOURCES TOWARD THE SUPPORT OF SENIOR HOUSING; NOW, THEREFORE,
BE IT
RESOLVED,
BY THE SENIOR ASSEMBLY AND THE SENIOR SENATE, JOINTLY, THAT THE SENIOR
LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2002 REGULAR SESSION, A MAJORITY
OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT THE GOVERNOR AND THE
LEGISLATURE DIRECT THE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT TO ACCEPT
THE CONSTRUCTION OF CONGREGATE HOUSING FOR THE ELDERLY AS CONTRIBUTING TO THE
EXPANSION OF THE HOUSING STOCK OF THE STATE; AND BE IT FURTHER
RESOLVED,
THAT THE GOVERNOR AND THE LEGISLATURE DIRECT THE DEPARTMENT OF HOUSING AND
COMMUNITY DEVELOPMENT TO ACCEPT AS COMPLYING WITH STATE HOUSING ELEMENTS LAW,
THE DEVELOPMENT OF CONGREGATE HOUSING FOR THE ELDERLY THAT IS AFFORDABLE AND
ACCESSIBLE WHEN THAT HOUSING HAS BEEN IDENTIFIED IN LOCALLY ADOPTED HOUSING
ELEMENTS AS FULFILLING A COUNTY OR CITY'S "FAIR SHARE" OF THE REGIONAL
HOUSING NEEDS DETERMINATION; AND BE IT FURTHER
RESOLVED,
THAT THE SENIOR LEGISLATURE OF THE STATE OF
RESOLVED,
THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE SPEAKER OF THE ASSEMBLY, THE
PRESIDENT PRO TEMPORE OF THE SENATE, AND THE GOVERNOR OF THE STATE OF
CALIFORNIA.
